Terms of Service

These Terms govern your use of Emberstep apps, the public site at emberstep.app, and the product web dashboard at my.emberstep.app (together, the “Service”). By using the Service you agree to these Terms.

Not medical advice

Emberstep is a motivation and personal history product. It is not a medical device and does not provide diagnosis, treatment, or health advice. Do not rely on it for clinical decisions.

Your data

You retain ownership of your activity history. Our practices are described in the Privacy Policy, including Health Connect local-only handling and Google Health API Limited Use commitments. You must only import archives and connect health sources you are allowed to use.

Accounts

Core mobile features work without an Emberstep account. Accounts are required only for cloud sync and the web dashboard. V1 identity is first-party email magic link only — no Apple, Google, SIWA, or OIDC sign-in. Accounts are created only from mobile enrollment; the marketing site does not open empty cloud accounts. You are responsible for the security of your email inbox and sign-in links. We may suspend accounts that abuse the Service or attempt to compromise others.

Subscriptions

Premium is offered as a monthly plan at $6.99 USD and a yearly plan at $44.99 USD. Only the yearly plan includes a 7-day free trial. Prices may be localized by the storefront. Billing is handled by Apple or Google via RevenueCat; their refund and cancellation rules apply. There is no web checkout in V1. Ending a subscription stops Premium capabilities but does not erase history you already hold on device, does not revoke badges already earned, and export remains free. Auto freeze tokens remain on the free tier.

Acceptable use

• No reverse engineering of our servers for abuse.
• No automated scraping of product surfaces beyond ordinary use.
• No uploading malware or unlawful content through support channels.

Intellectual property

Emberstep name, mascot, badge artwork, and product design are ours or our licensors’. Badge names and art are original; they are not affiliated with Fitbit, Google, Apple, or other device brands.

Disclaimer and liability

The Service is provided “as is.” To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Our aggregate liability arising from the Service is limited to the greater of amounts you paid us for Premium in the prior twelve months or fifty US dollars.

Changes

We may update these Terms. Material changes will be posted on this page with a new date. Continued use after the effective date constitutes acceptance.
